If I understand the question, uninsured driver strikes your vehicle and you are injured; however, you also don't have uninsured motorist (UM) coverage.

These circumstances do present a real challenge to compensation.

If the vehicle was owned by someone else, then you can pursue...

As far as I see it the answer is NO.

How are you damaged?

Fortunately. There was no reason to have needed to use the insurance.

It is like being in a building and leaving. 5 minutes later the building collapsed.

You can't sue because the building COULD have collapsed when you were there

Q: Can a uninsured motorcycle driver get a rental if they are not at fault but the other party is?

I was involved in a motorcycle accident where they were cited for being at fault. They have insurance, I do not. Is it possible for me to get a rental, as i have no vehicle, and the motorcycle is totaled?

Yes it is possible. Oftentimes, if liability is not an issue, the adjuster for the at-fault party may authorize a rental and pay it directly. However, if the vehicle is totaled, they may either not pay you for a rental, or could authorize a short rental term while they are negotiating with you or... View More

You did not ask a question, but you seem to be wondering what to do in this situation. Also, I assume that the lawyer sent you some sort of demand regarding damages for bodily injury. Q: Why is my insurance company paying?

I was a passenger in an Uber accident. My attorney is harassing me for my insurance information so they can cover my medical bills.. I was a passenger, not a driver. This wasn't my fault. Why is my insurance company paying? Doesn't Uber have a 1,000,000 insurance policy?

In Florida, your Personal Injury Protection (PIP) is your mandatory health insurance for auto-related injuries. It is also known as the No-Fault law. So, in any accident in which you are a driver or passenger, your own PIP pays your medical bills (80% of reimbursement rate) up to $10,000.00.

Your auto insurance (PIP) will cover your medical bills initially, up to $10,000 generally. You likely have a claim against the at-fault driver. You should consult with a personal injury attorney immediately. Most firms, like ours, offer free consultations.

Doctors, hospitals, etc. want to get paid for their services now. They generally don't wait for your claim/lawsuit against the other driver--which can last many months or even years--to conclude before they get paid. It is also a risk because if your claim is not successful for some reason,... View More
