Q: No insurance

My husband has court tomorrow for a no insurance violation. He was also at fault for an accident when he was cited. Our car was totaled and my husband lost his job the next day and doesn't have a vehicle. Someone told me it would look better in court if he has current proof of insurance. Is... View More

A Kansas attorney situated in or near the county where the hearing is scheduled could advise best and most cost effectively, but your question remains open for a week. It's possible the court could ask why someone would insure a non-roadworthy vehicle that was declared a total loss after the... View More

Yes, but it is likely any statement you made while in custody can’t be used against you.

They can, however, offer testimony from witnesses and other evidence to try to prove your guilt.

If you received a speeding ticket from an officer of the City of Lenexa while in the City of Olathe, the jurisdiction where the violation occurred typically has the authority to issue the ticket. It's important to follow the instructions on the ticket for addressing it, including options for... View More

Kansas, like in many other states, the law requires drivers to carry proof of insurance at all times while operating a motor vehicle. If you were issued a ticket for no proof of insurance and you did not have the required proof at the time of the traffic stop, it may be challenging to contest the... View More

Why did you get the citation? Probably following too closely. You have to maintain a proper following distance so you can stop in the event of an emergency. This situation arises in the area of traffic ticket law. You need to discuss with an attorney in your jurisdiction that specializes in this... View More

I was given warning for no front plate due to hitting animal same night. Same Missouri deputy, who harrasses me a lot, showed up to assist a custody swap, 3 months later issues me a ticket for the no plate, saying he has a year to change his mind. Probably legal for each day that you drive the car without the front plate. Unfortunately the state legislatures don't issue citations to the people most responsible for this, car dealers that sell cars without all the plates. This case arises under traffic ticket law. You need to discuss... View More

Being issued a license to drive and driving on state and federal highways is a privilege, not a right. You can lose that privilege if you are a habitual offender and the state revokes your license. Being self employed, or needing to drive for work is not a defense to habitual offenses. Any... View More

I don't think you are in Kansas any more, Toto. This is sooo strange. If the ticket is written for a different person, it could be that the police officer handed you the wrong copy. You need to check with the court to see if you are scheduled for an appearance on a traffic ticket and go to... View More

Q: If my license is suspended and I am driving my girlfriends truck when a cop hits me going through an intersection

with only his lights on and no sirens on— who is at fault for property damages and medical bills? The accident was undeniably his fault, but I did receive a must appear citation for driving while suspended- habitual violator.

If the police officer is more than 50% at fault for the collision, then the city he works for will be liable for that percentage of all your damages. Your damages will include medical expenses, lost wages, and pain and suffering damages. The city most likely has some form of insurance to cover this... View More

I would definitely keep the original ticket, request a trial, and offer the original ticket into evidence. It may be enough to create a reasonable doubt as to the time of your traffic stop which sounds like it is a determinative fact in your particular situation.

Q: I was pulled over for speeding and ended up with possession of controlled substance. Can the evidence be suppressed.

The officer never addressed the initial reason for the traffic stop. I believe he was on a "fishing expedition "and went beyond the scope of the initial reason for the stop. It sounds like your attorney is doing his job. Either plead guilty or start preparing for Trial, and a possible appeal. It does not appear that further Discovery will help any more than what you already know.

Unfortunately, he would not be liable automatically, but those facts would contribute to having a jury determine that he was, in fact, at fault. Ultimately, it would be up to a jury to place a percentage of fault on each of the drivers. They could determine that the other driver was 90% at fault,... View More

Hard to answer without knowing exactly what ticket the officer issued you. My assumption is that you were issued a failure to exhibit licences summons. This ticket is payable and does not require a court appearance. Although if you hire an attorney, they'll maybe be able to reduce the fines on... View More

Generally speaking, not knowing the law is not a defense. You should seek a traffic attorney if you don't know what to say in Court. I will also seek the advice of an immigration attorney to fix your F-1 Out of Status as soon as you can. It is not a good idea to drive without a driver's license.
