Probably, depending on the sales contract. It still has an implied warranty of fitness for a particular purpose.

You may have a claim for wrongful repossession and damages if the loan was not in default. Consult a debtors rights lawyer.

If they accepted, they would sell it and you’d still be liable for the deficiency balance. Consult a bankruptcy attorney and see what your options are.

Q: I would like to publish a certain type of ad for my website, but I want to know if it falls under false advertisement.

I sell magnetic therapy bracelets online. They are not proven to have any benefits with studies, but I want to run an ad that has a picture of a bracelet and also a before/after of a woman who lost weight. Does this fall under false advertisement and can I get sued.

If you are going to run the ad, you should put the disclaimer on the ad that you set out above. That should protect you from any claims of fraud.

You will have to file suit to recover it. Or, you can pay it under protest, then file suit to recover.

Q: recovering your restitution money

Person paid restitution to a company thru local courthouse via escrow. The company is no existing filed bankruptcy. Can person file to get the money they paid in restitution back since company out of business and does not exist.

I’d file in the case that ordered restitution. Cig you have proof of payment, you should be fine.

Statute of limitations is either 2 or 5 years, depending on which statute you proceed under.

Q: I bought a bottle of Vet’s+Best Waterless for cats and it didn’t do that but it actually killed two of my cats can I sue

You need to have them autopsied do the vet can testify about the causation of the deaths. If he links their death to the product, then you could have a claim.

Q: can state Farm deny my renters insurance claim if it's the second one I've filed in 5 months? I am having problems with

They should not deny your claim if it is a covered event, whether it has been five months or five years since the last claim.

Q: What are the time requirements by creditors for notification after car repo in Ky. Car repo'd three weeks ago.

This was after they had told me they were going to work with me. How long do they have to notify me recovery requirements? How long do they have to sell it?

You need a consumer debtors attorney to help you with this case. Time limits vary on notice provisions. Consult a lawyer immediately before the car is sold.

Q: Can I sue my neighbor for his 20 cats using my yard as a litter box. And using my vehicle, deck and driveway as a bed.

Q: Hello my wages are currently being garnished from a secured loan i had back in 09. But the car was never repossessed
