Q: I was in a bad car accident 2-3 years ago sitting passenger, broke my jaw and had surgery. I need a second surgery.

Yes, but more importantly you need to make sure that they take care of any liability for damage they caused to others.You need to notify your insurance, get a copy of the police report, find out the insurance for the auto shop.

Yes, if you stop paying they can sue you for the amount you still owe them. It seems strange that the insurance company paid you without getting a release from the dealer (or loan company; whoever had the lien on the car).

The other driver's insurance will pay for the fair market value of your vehicle and then your gap will pay the balance of the loan.

Very likely, the collection notice will result in a lawsuit and then the lawsuit will likely result in a judgment if you do nothing. Mostly likely yes as to a portion of the fee. He would be entitled to what is called quantum meruit fees. ie: ha can be compensated for the work he has done or contributed to the case.

There is truth to what your attorney is saying. Your attorney has to get permission from the UM carrier to accept the settlement with the at fault party.
