Q: What kind of attorney do I need?

I was in a car accident while working as a delivery driver and the other driver was at fault. Do I need a car accident attorney or a workers comp attorney? Is my employer required to carry workers comp insurance in Florida?

Good question. Your case sounds like a workers comp claim against your employer, if in fact you are an employee and not an independent contractor. Some employers try and avoid responsibility by hiring independent contractors.

If I understand your question correctly, you do not have insurance and you are being sued for an accident.

If you do not have insurance, then your only recourse is to hire an attorney to defend the case. If you did have insurance, then the insurance company would have defended the case.

If a friend is riding with you and you cause an accident you are liable. Florida Law holds the owner of the vehicle that causes an accident liable and well as the driver of the vehicle.

Q: Hello, my father was involved in an accident, he is a truck driver who lives in Miami, FL

The other person in the accident is from Alabama. This person did not provide an insurance, yet he had a brand new car. He is the person at fault. My question is where would my father go from here? He would at least like the persons insurance to take care of the damages cause to his truck.

Did your father get the person's name, address, and insurance carrier? If so, he can make a claim with the insurance carrier.

No. You can bring suit if you have an injury or damages to your car. Most likely if you only have damages to your car your insurance and the auto insurance of the government employee will handle the repairs out of court.

Yes. If the amount of damages are less than $5,0000.00. You will need to be able to prove that the other person did the damages and you will need the testimony of a body shop person to prove up the amount of damages.

No. I believe that in Florida it is a comparative negligence state--if you are 20% at fault you get your damages reduced by 20%. The other persons insurance will always say its 60%. You need to talk to a member of the Florida Justice Assn--they give free consults.

I believe that your lawyer told you correctly. Auto accidents can be devastating financially as well as physically. It can be very difficult to get through them when you are not able to work. There is not any type of program to assist you during such a difficult time.

Find out the process to contest the lien. Makes sense to get a copy of your record so that if an attorney is needed you aren't paying for them to do the basic legwork.

As careless driving in most states is a point violation, I suggest you consult a lawyer who handles citations before that court, to see what your options are (for instance pleading guilty to the no permit and some non-point violation, even if it didn't happen [for instance no valid inspection).
