Q: My friend was booked into a county jail.on pending murder charges. I looked in the roster. Wasn't on there.

Vinelink says that he was out of custody - missing resync record. Whats does this mean, and where is he being held?

Q: Does the Dimler rule apply for 54 in a 45, or not because it was not a 55 or a 65 speed limit zone?

My son received a 54 in a 45 speeding ticket. The office said it would not impact insurance since it was only 9 over. In reading the statutes, this seems fuzzy when it’s in this speed limit zone.

The Dimler Amendment would not apply here. However, an attorney may be able to help find another way to keep this from hitting the driving record and impacting insurance rates.

Q: If I was falsely accused of a crime & the charges were dismissed& years later be changed with & convicted of related.

Is that double jeopardy seeing the the conviction was because it was said that the charge that I was convicted on came from the charges that was dismissed?

This is unlikely to trigger double jeopardy. Generally jeopardy is not triggered until trial. If the case was dismissed pre-trial, the state is likely able to bring charges again.

Minnesota is an at will employment state. That means that unless you have a contract stating otherwise, you can be terminated for any reason (aside from membership in a protected class) or even for no reason at all.

I am not aware of any legal requirement to speak to your landlord unless there is a provision in your lease agreement that says this.

Q: Does a Crim/Traf Non-Mand (fishing without a license) stay on your record if paying the fine.

My son received a ticket Crim/Traf Non-Mand (fishing without a license) while in fish house with two other friends. He did not have a pole in his hand but 3 lines were in the water. DNR gave him a ticket for 97C.301.2. The DNR say if he pays the fine it will not be on his record. Is that accurate?

Typically paying a citation will create a record. However, if this is a petty misdemeanor, that is considered non-criminal. If he wants to keep it off of his record, he should consult with an attorney. There are ways to keep these things from becoming a conviction.
