Q: Can I go after my personal insurance as well,just my last question on this topic.

I am going after both insurance companies so I want to know exactly my case is worth because my MRI suggests major damage to my body.

My job sent me home because I couldn't perform,can I go after my personal insurance as well as I have excellent auto insurance.

Q: I have a personal injury/accident claim filed with an attorney in Orlando.

If I want to fire him will I be responsible for the 331/3 fee and then need to pay my new lawyer another 331/3 fee?

Mostly likely yes as to a portion of the fee. He would be entitled to what is called quantum meruit fees. ie: ha can be compensated for the work he has done or contributed to the case.

Our atty has stated that he cannot give the settlement funds to us until we have settled with our ins company under our UM coverage. Also that we cannot go after the driver personally does this sound right.

There is truth to what your attorney is saying. Your attorney has to get permission from the UM carrier to accept the settlement with the at fault party. Good question. Your case sounds like a workers comp claim against your employer, if in fact you are an employee and not an independent contractor. Some employers try and avoid responsibility by hiring independent contractors.

If I understand your question correctly, you do not have insurance and you are being sued for an accident.

If you do not have insurance, then your only recourse is to hire an attorney to defend the case. If you did have insurance, then the insurance company would have defended the case.

Did your father get the person's name, address, and insurance carrier? If so, he can make a claim with the insurance carrier.

Yes. If the amount of damages are less than $5,0000.00. You will need to be able to prove that the other person did the damages and you will need the testimony of a body shop person to prove up the amount of damages.

No. I believe that in Florida it is a comparative negligence state--if you are 20% at fault you get your damages reduced by 20%. The other persons insurance will always say its 60%. You need to talk to a member of the Florida Justice Assn--they give free consults.

I believe that your lawyer told you correctly. Auto accidents can be devastating financially as well as physically. It can be very difficult to get through them when you are not able to work. There is not any type of program to assist you during such a difficult time.

Find out the process to contest the lien. Makes sense to get a copy of your record so that if an attorney is needed you aren't paying for them to do the basic legwork.
