I'm sorry about your brain injury. I'm not certain if this is an admiralty/maritime matter (a category chosen for the post). It looks more like product liability (injuries involving dangerous/defective products, including pharmaceutical drugs). There isn't very much detail to go by... View More

A Washington attorney could advise best, but your question remains open for two weeks. There are attorneys who handle insurance-related litigation. It sounds like you already have an attorney handling ticket-related aspects of the matter. In terms the insurance premium issues, it's worth... View More

Q: In Washington state. Do I HAVE to list anyone living with me on my car insurance? Does it follow the car or driver?

It was my understanding that the car is what is insured and not the driver.

A Washington attorney could advise best, but your question remains open for a week. Insurance carriers are within their rights to ask what other drivers of the vehicle are in the household. In terms of asking simply about household members, you could check with your state's department of... View More

There isn't enough information here to give a full answer. One critical fact would be what type of lawsuit this is. Based on the categories you've selected, I am presuming you are being sued for injuries stemming from a car accident for which you were at fault.

If that's the...

A Washington attorney could advise best, but you await a response for three weeks. This sounds like a difficult claim, and such situations do arise when going from one insurance carrier to another, and a new claim arises near the start of coverage. If you've been issued a denial, review it if... View More

A Washington attorney would be able to advise best, but your question remains open for two weeks. If the card in question resulted in the ticket, it's difficult to say whether it would be adequate in court as a defense without seeing the start and end dates and times of coverage on the face of... Q: How often does a previous injury affect an auto-injury case? Without offering information about a previous injury.

I have a 5-year-old medical bill in collections from a previous injury that is in close proximation [on my body] (but not exact) to this auto injury I just had. Will this show up somehow and affect a possible case? It was in another state that I don't have a policy in or residency in.

Good question. Your issue is a common one in most personal injury cases. A reputable injury attorney knows how to deal with this.

You are only entitled to make a claim for the injury that was "caused" by the wreck in question. Whether that means a completely new injury or...

Both types of insurance are important. The scope of coverage would depend on how the policies are written. There are general liability policies that cover bodily injury as a given. In the policies you are exploring, bodily injury coverage appears to be an add-on. These terms are sometimes used... View More

Q: Is it legal for an employer to only give 24 hour health insurance paperwork turnaround time? We had no time to look

We had no time to look into our other options. At 24/hr, the premium is $900/month for a family, and it would only cover 50% and the deductible was insanely high. Forget the formula. That's bogus. If you lost an eye would 3 x the medicals be enough? No way. If you had one ER but went in as trauma and the bill was 19,000 and no follow up after, do you think they'd pay 3x19?

If your crash is serious enough to consider uninsured, you should...

No obligation on the passenger.

Q: If wildlife causes an accident are you at fault? Or domesticated animals running into traffic?

I drive rural roads with wildlife from small to big to bigger. Deer often cross the road unannounced. I often have to slam the breaks to avoid a collision. You aren't responsible for wild animals--no one is. As far as domesticated animals, the owner of the animal is responsible for them. In the example you gave I don't see why you would be at fault--the other individual collided with the deer, not with you.
