It doesn't really matter that you no longer have the insurance. If your insurance was in effect at the time of the accident, the insurance company has the duty to defend you in court (if and when the other parties to the accident actually file suit against you). And if they are making... View More
Can I recoup recent maintenance expenses? I would prefer my car be repaired rather than totaled. (Florida)
answered on Feb 21, 2018
Did you make a claim with the other driver's insurance company? Normally, they will pay no more than the "total" value of your car (what is meant by a car being totaled). So if your car's total value is paid, there would be no more due you for what you had paid in maintenance.

Yes--if you have Uninsured/Underinsured Motorist (UM) coverage.
There are special rules in your policy applying to UM. For example, you cannot settle your case with the at-fault insurance/driver without obtaining permission from your UM carrier, etc. So, you need to be careful. Perhaps you... View More

They should provide them--Florida's law is somewhat unique in that regard.
You may wish to consult an attorney if you think your injuries are severe enough to make that relevant. Look for a member of the Fla. Justice Assn in the county where the wreck happened. They give free consults.

This should be a workers comp issue. The injured party needs to consult with a workers comp hearings asap. The company's response of no fault is not correct and they should be telling the injury party to seek a workers comp claim. You can use the find a lawyer feature of this site to look... View More

Most likely yes, if they become aware of the same. The IRS has some of the strongest creditor rights of all entities with the Department of Revenue being pretty equal to the IRS.
If you have a payment agreement and you are current with the same, in theory the IRS should not need to mess... View More

No, you need to contact a personal injury attorney in your area who will determine if there is such a statute.

Accident was Aug 2016 received citation Jan 2018 is there a statue of limitations
answered on Jan 30, 2018
Typically the officer has 5 days to turn in a ticket to the clerk of court. You need to hire a criminal defense attorney to look into this in detail as it does sound like the ticket issued so long after may be invalid or outside the statute of limitations.
Hope this helps and good luck,

You need to file a claim with her insurance and your own insurance company. If you have full coverage your insurance will handle the repairs.

answered on Jan 22, 2018
Not sure if his driving with a suspended license will affect your claim.
First step is to make a claim against the commercial truck's insurance and your own if you have full coverage. (if no full coverage then make a claim to the commercial trucks insurance).
