Take photos. Get names of any witnesses. Make a claim with Tires Plus. The owner of the vehicle which the technician backed into should also make a claim (strength in numbers) for the property damage.

I would think that your mother's lawsuit would enable her to recover for the wrongful death of your sibling. She should ask her attorney. But, if so, it seems that would bar any wrongful death recovery for you; when she prevails she would recover for her care with no additonal expense to you.
