No, the facts you state are not sufficient to allow a lawsuit against the doctor.
However, I am but one opinion. The best thing to do is to contact a personal injury attorney in your area to get a consult. Most firms who handle personal injury offer free consults.
Is there anything I can say to help with a dismissal? Or am I at the mercy of the judge

Potentially yes, but it is in the Judge's discretion to continue the hearing as well.
Her tree has fallen on my car. Who pays for damage? My car insurance or her homeowners insurance
answered on Sep 17, 2017
Check the terms of each policy. One or both policies may have language which specifies which pays in this situation. If not, the carriers probably will agree to split the difference.

Haven't had the chance to do what, secure auto insurance? If so, make a claim against your neighbor's homeowner's insurance.
After the accident in a mall parking lot while waiting for the police to arrive they exchanged insurance information. She made a comment that she had to sue the insurance company in her last accident to get paid. My son was concerned about this comment and shortly after the police arrived she... View More

Under Florida law the driver and the owner are both liable for an accident caused.
Your insurance company will handle the case and will defend the case on your behalf. Depending upon the amount of your coverage you may have some personal liability. Your liability if any will be only after... View More

Technically yes, and technically no. The towing company should not be so rigid if you attempted to retrieve your vehicle and could not due to their office being closed during the storm. I suggest the best option is to pay what is needed asap to cut off the charges and pay under protest if needed.

No really a way to say or declare who is at fault from the facts that you describe. Typically the driving who has clear visibility is considered to have a greater chance to avoid an accident (ie: driver of the other car), but again I cannot state or predict the at fault driver.
I hope... View More
On July 26, 2017, my vehicle struck by another car, whose driver, I contend, ran a red light. I believe the diagram of the accident verifies my contention; however, the accident report claims there were 2 unnamed "witnesses" to the accident who claim that I was at fault. The accident... View More

A contractor worker for my Mom has befriended her and been very helpful to her, with my sister and I living far away. Yes you have a dangerous situation. Under Florida law the owner and the driver of a vehicle is liable for any accident involved.
Not sure how you fix the situation from the distance you are but you try to stop this person from driving the car.
Good luck.

received a letter from DMV office saying the license is suspended for 3 months. Can the DMV has the power to change the court order?
answered on Aug 14, 2017
Likely no. One of the two dates is a typo. Best suggestion is to contact the court to get a copy of the judge's order. I would say that the courts ruling will control over the dmv.
Good luck.

I was in an accident a few weeks ago with a Jacksonville sheriff. My brand new car was totaled. The officer was listed as the at-fault driver, so I assumed it would just be a matter of my insurance company contacting their insurance company, and my car would be replaced. Guess I was naive. It may not be fair. But the facts you state appear to be correct.
I suggest that you hire a personal injury attorney as they might help you process the claim and evaluate as well.

They say they have to do a liability investigation, they're client was ticketed for running the traffic light and causing the accident. Also a witness gave a statement to that fact.

If there was an accident, you should absolutely call the police to have the accident investigated and reported by them. The police will require the person to show his insurance.

There is not a way to answer this question as the determination of "at fault" is up to a judge. However, for purposes of insurance coverage an insurance company can decide not to cover the accident if they comply with or within the terms of your insurance policy.
