My daughter's car was hit from behind on December 16 2022. Insurance company has made no movement on paying out the car. Her car has been in impound. She has been paying ride shares and walking to work. What can she do? Does the insurance have time requirement to resolve the issue?

An Illinois attorney could advise best, but your question remains open for two weeks. Some of your primary options include attempting negotiation with the carrier, filing suit in small claims court or civil court, or arranging a consult with an attorney to discuss them filing suit or continuing... I was merging but I also had to avoid a semi that drifted in my lane. The stretch of high way bends right and at the end of that bend there was a black abandoned vehicle with no lights on or anything to signal they were stopped. The second I go to merge and avoid the semi I hit the abandoned... View More

An Indiana attorney could advise best, but your question remains open for two weeks. I hope you are okay. It sounds like a very serious accident with the flip-over. From a textbook standpoint nationwide, it's possible to argue that both of you bear some liability. The fact that no measures... View More
I had no knowledge the police had been notified, therefore I left. Other civilians called an ambulance. There were no injuries.

answered on Dec 12, 2022
If you were parked and somebody hit you hard enough for bystanders to be so concerned that they called the police and an ambulance, the police will wonder why you would leave without exchanging insurance information or making a police report for your insurance. The conclusion that would be drawn by... View More

Your son's death was a terrible tragedy. That said, there is something wrong with the facts. "There are no buses to your home" CANNOT be reconciled with a bus stop a few houses down. Either way, his custodian (the girlfriend's grandma) is NOT responsible for his death.... View More

An Indiana attorney could advise best, but your question remains open for a week. One reason for the difficulty could be that if the matter only involves property damage, not every accident law firm handles those. There's a tab above if you want to make further efforts at contacting attorneys.... View More
I don't have insurance and I'm scared. The cops came here but I hadn't made it home yet. I don't know what to do

If your friend had insurance, the accident is covered.
If your friend didn't have insurance, you gave your friend permission to drive your car, knowing that it was uninsured so you are responsible for all property damage and/or personal injury that resulted. Whether you were driving... View More

An Indiana attorney could advise best, but your question remains open for two weeks. Until you are able to consult with a local attorney, not having insurance does not necessarily make one liable for damages. The person would be in violation of state laws for having an active insurance policy in... View More
My car is mexican and insurance only covers third party accidents. The sheriff said I needed to go to the city so that they would make the electric company pay for the damages. Inspection determined that the pole fell due to the wood being rotten. The car suffered great damages and is unusable now.... View More

Hopefully, you took several pictures of the car with the downed light pole so that you can prove that the damage to the vehicle was caused by the downed pole. You said that the sheriff was there so the sheriff should have prepared a report, memorializing the downed utility pole and the damage to... View More
When I was 17 I got into a car accident in Indiana. It was a friend's car. I was found at fault for the accident. I had an unsat judgement against me in 2007 and it expired 2014. If the suspension ended in 2014 then there should be no reason it would prevent you getting a license. However, there may be a reinstatement fee. Also, there could be other reasons preventing you from getting a valid license. If you do not have a myBMV account, set one up and look at your... View More

In Indiana, it is illegal to leave the scene of an accident with a domesticated animal before you call the pet's owner or animal control. As a dog lover, I feel your pain. That said, if the driver had lost control while taking evasive action, you would be responsible for all property damage... View More

Can you drive? Yes, but it's not legal and you could get pulled over for it. Just be careful and perhaps go get a driver's side mirror.
I hit a sizable, unmarked pothole on US 31 within St. Joseph County limits that did significant damage to my car. I filed a claim and a county representative said they would not pay it because they aren't responsible for "weather-related" damage to the roads. All damage to roads... View More

The person with whom you spoke was right, for the wrong reason. US 31 is an interstate highway so you would need to make a claim with the state of Indiana, NOT St. Joseph County. Before you can make a claim, you must file a Tort Claims Notice. The form number is 54668. A completed form must be... View More

Technically, yes. Practically, no. Remember this and increase your coverage in case you or a loved one is injured by an uninsured driver or someone with minimum coverage.

Possibly, but you need to review the provisions and language of your policy-----often times, a requirement would be that there is an independent witness to the accident in order to invoke UM coverage. Good luck.
Their client was at fault, been trying to get a reasonable settlement outside of medical liens, and Selective insurance is now trying to say they don't owe us anything because we couldn't come to an agreement on what was a fair amount to resolve the issue.

If your accident occurred on or before 10-08-19 and you did NOT file suit on or before 10-08-21, the Statute of Limitations HAS run and you have no right to recover anything. This is yet another reason why you should have hired an experienced personal injury attorney. If the attorney missed the... View More

You admit that your husband did not have a valid license at the time of the accident. Your insurance company may well be refusing to issue a certificate of coverage but that refusal... View More
