Q: I received a letter yesterday from the Louisville Metro Housing Authority Section 8. It said that I was overpaid.

I rented my house from 2014-2017. Section 8 made direct deposit payments. When the renter moved out, she notified section 8 and they discontinued payments to me. They began making payments to the renters new apartment. Do I need to pay the overpayment?

Q: Can I request a judge to quickly rule on a single motion for Writ of possession, or will I have to file a civil lawsuit?

You need to file a complaint with the Kentucky Labor Board regarding all the monies owed to you. As far as the eviction, it appears you may have some defenses. Check with your local legal aid society regarding possible pro bono or reduced fee representation.

It depends on what your lease agreement says. It is common for the agreement to say the lease automatically renews month to month at the end of the initial term if neither party has given written notice of intent to terminate the lease at the end of the term

Yes. Your brother can sell it and the new owner can have you removed. With no will, mothers estate will be divided among her children so you will have to either buy out their shares or sell your share and receive the money.

Technically it could be considered criminal trespass in the third degree if there are clear signs that this is private property or that you are in a housing development or section 8. If you were not charged by the police you likely don’t have anything to worry about.

You have two separate issues: 1) a possible sexual harassment case and 2) an eviction. Unless you have a lease on the space, they can ask you to leave anytime with reasonable notice.

Q: My partners landlord added my name to his lease without my permission or app. And added me to an eviction.

She lied in court saying that we added my name to the lease. When we obtained the copy with my name on there from the leasing office. We were advised by county clerk and prosecutor to pursue legal action. Do I have a case? I don't know who to talk to.

No the automatic stay does not protect you automatically from a lanlord eviction. However there is a section of the bankruptcy code that allows you to pay the rent you are behind on into the court and force the landlord to accept it.
