Q: Why does Arkansas violate the intractable pain act of 2006? Can they be sued?

Arkansas is supposed to have a law to allow doctors to prescribe pain medication that actually works but they have been depriving patients of this medication and causing them to commit suicide or turn to dangerous street drugs so they don't have to suffer 24 hours a day. The Intractable Pain Act provides a defense to licensed physicians for prescribing narcotics to certain patients with intractable pain. It provides a defense to criminal prosecution and does not create a civil cause of action, much less one against the state.

That does not REQUIRE a...

You could try searching under ADA and civil rights law firms. You could check with the Arkansas Bar Association. Most... View More

"It was years back" is a real problem with your case. An overbearing judge may have unintentionally misled you. You were probably not in a state of mind to appreciate what was happening to you at that time as well. What you describe is fraught with problems from a legal perspective.... View More

Under the circumstances, you describe I would sell and move. You need direct advice from a tax guy, but you a reasonable period of time to reinvest to avoid capital gains.

Do you have a county sheriff or local constable? If you are in the county there is some county-wide law enforcement body.

Possibly but the statute of limitations on lawsuits like that is typically 3 years. I’m unaware of a way to sue in Arkansas for something like this beyond the three year point. I’m not saying you can’t, I’m just saying I’m not aware of a way to do it. This is not legal advice you need to... View More

Last day of your contract that you are not going to sign another lease, can they still penalize you? It depends on what your lease says. If the lease is silent as to any notice requirements before moving out, you are perfectly within your rights to move out the last day of the lease and are under no further obligation to your landlord. However, if the lease requires a notice prior to moving out,... View More
