Q: Am I entitled to a refund of my deposit to a painting contractor that continuously reschedules? It's been 60 days

I received an invoice for $200 within 5 minutes of receiving the quote on April 19 to get my bookcase job on her schedule. I received a past due notice in less than 24 hours. It was paid within 24 hours. I was informed the deposit goes towards my balance.

Q: Can I file a pleading to a civil summons in person at the courthouse (as there is a filing fee) within the 10 day period

as opposed to via certified mail? Am I required to send a copy of my response to the plaintiff’s lawyer within the 10 day period as well, or can that be a day or so late as long as it’s filed with the court on time? This is Jefferson Parish, Louisiana, 2nd Parish Court. Thank you so much.

Maybe----I assume that you have associated paperwork when you provided the deposit. The paperwork probably details the conditions and how you can receive a full return of your deposit. If paperwork is confusing, then contact an attorney to review it for you and represent you.

Q: Im currently in a debt management program. One of the credit cards listed in the program had me severed with legal paper

Should I responded to the clerk of courts or should I let the debt management company take care of the issues or should I contact the lawyer that had me severed with the papers and try to make a settlement.

Unfortunately this is not uncommon for people dealing with debt management companies. You should discuss this with an experienced bankruptcy attorney. The filing of a bankruptcy may prevent the credit card company from obtaining a judgement against you.

If the judgment is over 10 years old and was not reinscribed then you can file an affidavit with the clerks office to have the judgment cancelled. Our office handles residential closings and have handled similar issues with no problem.
