Is there a written contract between the 2 of you and what does it say in regards to the deposit being refundable or non-refundable. If there is no written contract or the contract is silent, then you have a case that it is a refundable deposit, however, depending on the amount of the deposit and... View More

as opposed to via certified mail? Am I required to send a copy of my response to the plaintiff’s lawyer within the 10 day period as well, or can that be a day or so late as long as it’s filed with the court on time? This is Jefferson Parish, Louisiana, 2nd Parish Court. Thank you so much.

Basically, yes, yes, yes, however a person who represents himself might also be considered a fool. That said, at a minimum, I would seek a consultation with a lawyer--pay him for 30 minutes ----1 hour of his time to obtain advice and suggestions on what to do/how to do it if you are intent on... First thing you need to do is hire a criminal defense attorney in your area as an attorney would be in the best position to assist you in this matter and to help you get the best result possible. If motion to continue Has been filed by both parties but has not been approved by judge before a court date and the Plaintiff’s attorney does not show will the case be dismissed?
answered on Jan 14, 2022
Not enough information has been provided. What is set in court in which both parties have filed continuances? Trial? A pre-trial motion? or what? Are you represented? If the request for continuance has not been denied, then in all likelihood it will be granted on or before the court date. I... View More
Insurance company fighting to not pay when foundation is compromised

A Louisiana attorney could advise best, but your question remains open for three weeks. The dispute you describe sounds like it met an impasse between your assertion for a new foundation and the insurance carrier's position. Maybe----I assume that you have associated paperwork when you provided the deposit. The paperwork probably details the conditions and how you can receive a full return of your deposit. If paperwork is confusing, then contact an attorney to review it for you and represent you.

Not enough information is provided in this post----are you in criminal or civil court? If civil, what type case is this? This is necessary information to properly respond---my suggestion is that you consult with a lawyer in your area and discuss the specifics with him. Good luck.
Does the first signed contract negate the second. Are will I be held to both ? What are my rights to cancel in Louisiana ?
answered on Oct 6, 2021
More information to properly answer this question is needed and most likely a proper answer can only be provided if one were to review both contracts. If this the situation where the same parties wrote up 1 contract and then agreed to write up a 2nd contract? Or is the property owner party to... View More

A Louisiana attorney could advise best, but your question remains open for two weeks. Your post does not indicate that you suffered damages. If you did not sustain injury, there would not be a basis for you to sue. Having standing to sue would require injuries. And if you did suffer injury, it... View More
Should I responded to the clerk of courts or should I let the debt management company take care of the issues or should I contact the lawyer that had me severed with the papers and try to make a settlement.

Unfortunately this is not uncommon for people dealing with debt management companies. You should discuss this with an experienced bankruptcy attorney. The filing of a bankruptcy may prevent the credit card company from obtaining a judgement against you.

To paraphrase a Texas judge: "You can sue a bowl of Gumbo." Most repair shops are licensed by a government agency, you can check for a city/county business license or a state license for auto repair shops. Find out who the license was issued to. Check for the name of an individual so... View More

If the judgment is over 10 years old and was not reinscribed then you can file an affidavit with the clerks office to have the judgment cancelled. Our office handles residential closings and have handled similar issues with no problem.
