If the value is such that it is not in your interest to consummate the deal, one of your options may be to cancel the sale. This will depend on the conditions you wrote in the P&S agreement. Consult with an attorney to evaluate your position.

Lot of questions here - Were you under a conviction whilst in jail? (then you may have been civilly dead under the law) That will have some impact on the analysis. Speak to an attorney to discuss the impact of what you are considering. It may turn out that what you need is a will. There are tax implications you should consider as well. There are ways to achieve what you desire without having to give the house to him all at once.

We are married. He is cheating and is verbally/emotionally abusive along with a history of drinking. I have family out of state that have opened their doors to the kids and me. Can I bring the kids there for safety and start a case for separation from the new state?

You may file the case in Rhode Island. The other state may have a residency requirement that could cause you to have to wait for up to a year before filing. Meet with a Rhode Island Divorce attorney to explore your options soonest.

There is no retroactive date enabled/listed for this law. Meet with a practicing attorney to explore other ways to approach this including possible expungement.

Probably not - unless the law itself specifies a retroactive date. It does not appear to.

Of course, your rights will be well defined if you made a written agreement concerning who would pay for the costs. . .

If you cannot resolve it between the two of you, you may have to go to small claims court to resolve the matter.

You cannot ‘drop’ charges once the police file them. You can help your father by getting him a lawyer who can work with the prosecutor and make sure that he or she knows you were not injured and you don’t want to go forward. Q: If I am still on the deed to the house my ex- husband and I owned in RI but he has passed, do I still own the house.

The deed states tenancy in its entirety with both out names listed. When we divorced he was to remortgage within a year, that was 2008. He did not until 2016. Also he never pushed me to do a quit claim because he said he did not plan to marry again. I am not listed on the new mortgage only the deed.

You own half of the real estate and your ex-husband estate owns the other half of the real estate.

It depends on the specific facts. Self defense works only when one us reasonable force in response to a threat. It’s a fact intensive inquiry. You should speak directly and in private with a lawyer.
