That is a typical response from an insurance company. You need a skilled and experienced attorney.

The value is impossible to determine from these facts alone. Assuming strong liability and other positive factors, the insurance company is not even in the ballpark.

Medical malpractice means that a doctor violated the standard of care. A bad outcome is not enough. Another doctor would be needed to evaluate what the doctors did.

Any hearing in court should be either audio recorded and/or recorded by a court reporter. You could request a transcript of the hearing which could be used to impeach the witness at a later date. You could file a Motion To Suppress Evidence, but if LEO had any plausible reason to think you were driving, it will be denied.

While such a case is possible, there are two hurdles that may be difficult to overcome.

First, you must prove they did something wrong. Bruised can happen without (and with) malpractice.

Second, your harm must be sufficient to warrant a lawsuit and what you describe may not be.

You can be charged with several Felonies. Apparently you have not been charged yet, but if passenger dies, expect to be arrested.
