Q: Do emotional support animals count towards a pet count in an HOA neighborhood?

Hi, i am looking to purchase a property in an HOA with a bylaw of 2 pets. I have an Emotional Support Animal, up to date on vaccines and documented. I also have two other dogs who are up to date on vaccines. Is the ESA exempt from the count per the FHA?

Yes, they do count towards the pet limitations.

I'm landlord-tenant attorney, so I don't know too much about the situation. It's not relevant really whether you live there or not; if the dog's presence is violating the terms of her lease, it could be grounds for eviction. But they can't evict someone in 24 hours--it's a much longer process.

Maybe they stole the dog, maybe not. But if they are not communicating with you because they want a "reward", they may be guilty of something.

Did they call you and send pictures of the dog by a cell phone? If so, you or the police can probably trace the call and identify them...

Q: In VA, if someone is banned from possession/ownership of animals are they allowed to live with someone who owns animals?

My friend was recently banned from possession/ownership of animals. He has not had a final hearing yet and been convicted of anything but the judge already ordered the ban. Does living with my friend mean that I also wouldn't be able to own any? What are the chances of them appealing the ban?

If he is not allowed to possess animals or own them then he would be wise to not be in a home where there are animals lest he get charged with an offense.

Q: Can we sue a veterinary clinic in another state (FL) for malpractice without a veterinarian letter claiming malpractice

We had a dog spayed in FL which had complications totally $15K. We've been unsuccessful in obtaining getting the surgeon to response back with a letter of malpractice against the veterinarn clinic in FL.

You can sue, but you will lose. Complications are a normal part of surgeries, whether on humans or animals. In order for the veterinarian to be liable for the complications, you have to show that s/he did something negligent, or below the standard of care. If you can't show that with... View More

If you were ordered by a Court not to have a pet then comply with it. Otherwise you go to jail. Someone will turn you in.

You don't have to disclose your assets, other than insurance limits, even during litigation, unless punitive damages are sought.

If your landlord was negligent, you likely can sue for any vet bills incurred treating your dog.
