We filled for divorce 2 years ago in NJ. My wife moved to FL 1.5 years ago, although there is no written agreement to allow this. I now also live in FL. Do we have to move the case to FL? Is FL a better state for me from a child support perspective or is NJ?

If the child has been living in Florida for more than six months then NJ will probably not accept jurisdiction anymore, meaning that they may divorce you but they will not address children's issues because the child does not live there anymore. I cannot advise you on NJ child support law.... View More

Only your wife can do this. You and she must sign the title over to just her, or however its done in Georgia post-divorce. That takes care of ownership. There's nothing anyone can do to take you off the loan, except your wife or you by paying it off. The divorce decree did not affect your... View More

If you've got everything set I'd recommend attempting a dissolution. Your county's domestic relation court will very likely have forms for this exact scenario that will allow you to dissolve your marriage if the two of you are indeed in full agreement.

NY state does not have "alimony". It has spousal support or maintenance, which is limited and depends on the respective income and length of marriage. retirement accounts, including pensions, are property subject to equitable distribution. You may be entitled to a portion of the... View More

Nothing. If someone refuses to sign the proper documents then you cannot file an uncontested divorce. You then have a contested divorce. You cannot force your spouse to sign papers they refuse to sign. So you would then file the proper pleadings, and have your spouse legally served. Your... View More

My husband and I bought a house 10 years ago. He put up the down payment (while I paid rent for 3 months while our house was being built). He also has paid the mortgage on the house the whole time. Depends...were the kids present when this happened? Otherwise, she's got a criminal matter going on that doesn't necessarily have anything to do with the custody and parenting time at this point. If you have concerns about her parenting ability related to these charges, you should address... View More

If the judge in your divorce case approved the agreement in which your ex-husband is to pay you a certain amount per month, your ex cannot on his own just decide to start paying you less - if he tries to do that, I suggest you file a motion and set up a hearing in front of the judge to consider...
