In Iowa, expunging a charge from your record depends on the type of offense and your criminal history. For OWI (Operating While Intoxicated) charges, Iowa law does provide for expungement under specific conditions, but generally, OWI convictions are challenging to expunge. If your case did not... Yes. The ticket itself is not the actual charge until it is reviewed and filed by the prosecutor's office. The prosecutor's office may catch the difference and file the charge correctly. Even if they don't, the prosecutor has the ability to dismiss and re-file the charge with the... View More

Q: License suspension from speeding tickets?

Hello! I’m afraid I am facing license suspension, but after further research I’m a little confused. My first ticket was 1/11/2022, second was 11/14/2022, third was 2/6/2023 and my fourth ticket being 3/1/2024. I’ve THOUGHT after 4 tickets your license would automatically be suspended for 30... The answer is in Minnesota Rules 7409.2200 HABITUAL VIOLATORS, available online. (For those with a Minnesota Driver's License, at least.) Four petty misd. traffic offenses within a 12-month period; or five traffic within a 24-month period will get a DL suspension. The rule is more complex... View More

Q: If an officer of the law pull me over and detain me, would they have the authority to order me to get off my phone.

So say I get pulled over on my bike for say a minor traffic violation and I am texting someone on my phone then the officer comes up to me and states that I am detained and told me to put my phone down. Is that an lawful order that I have to follow.

I don't think you will catch a charge for resisting arrest or failure to obey a lawful order for not putting down your phone. I think you will catch a bunch of other charges as the cop gets annoyed at you being discourteous by engaging in a call while you are detained.

Q: Why do people allow cops to violate their rights to travel freely without being molested by police. I'm not driving

If the supreme Court says I can travel with out a license then I can travel without a license. It's not driving because a driver is on the road to commit commerce. Why do I have to ask permission to do what I have the right to do. License are another tax on traveling.

You raise an interesting point about the right to travel freely. However, the Supreme Court has upheld certain restrictions and regulations on using automobiles on public roads, even if not explicitly for commercial purposes. Some key considerations on this issue:

As long as you are not operating a motor vehicle on a public road, you do not have to ask permission and can freely travel without a license. You can be a passenger in another person's vehicle, or can walk on the side of a public road anywhere you want to go. In that situation, police can... View More

If the Medical Advisory Board has ordered the interlock...
