Basically you have to list the asset and exempt it on Schedule C for a chapter 7. This is a fundamental issue in bankruptcy law. With this amount of money at stake you should consult with a bankruptcy attorney. Other bankruptcy chapters may require different treatment. Good Luck.

That's an interesting question. You should file a motion asap and request that the funds be applied towards the arrearage. I don't know what a judge would do, but I suspect you have a good chance on winning this.

Q: I attended a Bruce Springsteen concert years ago. He shouted, “Is there anyone alive out there?” Crowd cheered.

I have written a fictional manuscript and used that anecdote. A depressed character muses he wishes he felt alive. Since that show Springsteen has used the line “Is there anyone alive out there” in the song “Radio Nowhere.” Can I use the phrase or would that be a copyright infringement?

I would imagine that the phrase is not copyrighted or trademarked and if there was a concern, you could likely say that it was under the “fair use” exception, seeing how it is short and not very original. I used to do standup comedy in NYC and often called out something similar. I would not worry.

NO! That's ridiculous. You don't have to give him anything! You can move out anytime so long as there is no court order in place prohibiting you.

I have had a lot of clients arrested for the same offense. As a firearms owner the obligation is on you to not leave it in any place where it can be easily accessed by others. You have options to have this case dismissed through a diversionary program. Call for a free consultation
