I'm the mother out of wedlock do I have to fight for custody or do I have it until I'm taking to Court by the father of my kids ?

You don't have custody at this point. Being on the birth certificate merely means you are presumed to to be the father.
You don't have custody. You have to make a filing in court to get that

First of all, "date" means go to the local burger joint together. It does not mean have sex with. THe 26 year old may well be contributing to the delinquency of a minor. She will probably not be liable on sexual abuse charges because his is 16 years old. The 16-year old, naturally, is... View More

A judge has a lot of latitude to say what he feels will impact someone he is speaking to or sentencing or ruling on a request for ROR or lowered bond etc. Judges have an ethical duty to be courteous and to treat every person who comes before the court with dignity.... View More

Sounds like this is already on DFCS radar because she is at Rainbow House in the first place. You need to talk to an attorney about how your daughter ended up at Rainbow House and what may happen with her case.

Probably not. I wonder if you might consider being a bit more sympathetic to your grandparents. You say they're health isn't good but they're still providing you with a home to live in, food to eat, and clothing to wear. It may be pretty difficult for people their age to deal with a... View More

Sounds like a rough situation you're in - sorry to hear it. The only "restraining order" your grandparents might be able to obtain against your boyfriend is a Protection from Abuse Order, with them filing on your behalf (since you're a minor). They'd have to swear under... View More

Her levels are either going up and down because she's abusing or because of an organic reason. If it's organic, she needs an attorney and a medical expert to testify or that baby will be take by CPS.

Is who they are living with right now breaking any laws by allowing them to live there without consulting the legal guardian at all and also moving out of town with the child without parents permission
answered on Jun 16, 2018
You can't keep the child away from the parents. If there is a problem with the parents -- if they are unfit -- then a private custody petition would be in order.

If you've been told nothing can be done until she is 12, then it is unlikely the court system will do anything.
Is he able to leave legally at the age of 16 with out having to go threw an emancipation?
answered on Jun 13, 2018
No, he will have to be emancipated or have his parents' permission to live with you. If you believe his parents are unwilling or unable to care for him, you can seek a temporary guardianship over him, but that will have to be done in Colorado.
