In this situation, there are a few steps you can take:

1. Contact the insurance company and request a detailed explanation of their decision. Ask them to clarify why they initially determined that you were not at fault based on the dash cam footage, but later changed their decision to...

A Michigan attorney could advise best, but your question remains open for a week. It isn't clear why neurologists want proof of a release from 20 years ago. If you've been involved in a recent accident, the symptoms and test results would be new, and not necessarily related to the... View More

Q: Brother was rear ended in my car when it wasn’t insured, by a driver who was also uninsured. Who should file in court?

Insurance can’t help. Do I file or does my brother?

Juli Porto

If your brother has a claim for personal injuries, he is the claimant. Even though he was driving your car, he may have coverage from his own insurance company for his personal injuries. It is best to seek advice from a lawyer on this issue, and most, including myself, will offer free consultations.

A Utah attorney could advise best, but your question remains open for two weeks. Until you're able to contact a local attorney on state-specific laws, in most places there is an obligation to exchange driver info and insurance info. That would probably extend to phone follow-ups in most... View More

I am sorry for your loss. Side window air bags might prevent ejection. Seat belts do a better job of that. You may have claims against the vehicle manufacturer, the rental agency, and/or the driver of the other vehicle (if any). This is too complex for analysis on Justia. You will need to... View More

Q: A civil citation states we were negligent owners in an accident, but we sold the vehicle. How can we be removed?

Ask the lawyer defending you in the accident case to file a traditional motion for summary judgment asserting that you were not the owners of the vehicle at the time of the accident. You can attach the bill of sale and registration as summary judgment evidence.
