If he fits the legal definition of your “immediate relative”, then yes. If he is subject to a preference category, and his priority date is not current, then the answer is no. You should consult with counsel for more specific advice.

The divorce can be completed quickly if the two of you agree on all terms. If not, then you can file for divorce and serve her. But, you should hire an attorney in either case to ensure it was done correctly.

Q: Is drug screening a requirement for return of custody if no drugs have been found

The department is asking for everyone in household to do hair follicle's when no one has drug charges nor on probation in order for a 16 year old to return home . Should this be so??

They have the right to ask for a drug test. If the parents cannot pass a drug screen, then the environment may be deemed unsafe for a child to return home. Usually, marijuana and CBD is not an issue, but testing positive for other drugs will be a problem.

There is no law that entitles you automatically to half of a business. When you go through a divorce you can present evidence and testimony regarding what you feel you are entitled too and the Court will make a final determination on what, if anything, to award you.

All depends on the jurisdiction, as the registry entries are different from circuit to circuit, and even sometimes clerk to clerk.

The best way is to verify specifically with the clerk in writing. EVERYTHING needs to be in writing if at all possible.

There may be a conflict of interest for the attorney if he actually represented you, then represented someone else against you. But he may claim he represents the Estate. You should have brought this up when he moved to remove you as PR. The State Bar might be interested.
