Q: Someone used to name to purchase things online

Someone has used my name to make food orders costing up to $1000 each and some indecent DVDs and have them sent to my office. The person has however used a different spelling of my name (e.g. Sean Burke spelt as Shaun Berg). Does it still considered as identity theft since the spelling was... View More

I am unclear if you are out any money. It sounds like harassment more than ID theft. Check your credit report to see if your ID has been compromised.

Not likely, as long as you two are not doing anything illegal including him having you out past a city or town curfew, and your parents tell you that you can't leave the house but you do to go hang out with him, it is unlikely he gets arrested for you two simply being in the same vicinity of... Q: My ex will no longer accept emails for our regular ongoing communication about the children. He insists on texts only.

We live in Florida. We have been divorced for 6 years. We have always used email. Two months ago, I started getting responses to my emails saying that he longer accepts emails and to text instead. Do I have to comply? (I think that he simply does not want his email rants on the record.)

No, it's not malpractice to give what are normal professional courtesies. If your former counsel gave the extension, and the other side relied on it, and they filed the answer in time, I suggest you tell them you will agree to vacate the judgment and allow them to answer--a judge will do it... I don't see it.If they both had access to the email and he never changed his password, it's not the US mail she interfered with.

The document itself is an electronic copy so it's not as if she destroyed something irreplacable.

Talk to your attorney about the possibility of filing a suit for malicious prosecution, if that is available in your jurisdiction, or perhaps the jurisdiction that you were criminally charged.

You need to actually speak with an attorney who handles these types of cases, juvenile dependency. Without doing that, there probably is no hands on help available to you. Instead of asking how to get your children back, you ask only if you can sue them? I don't get it.
