It depends on the facts of the case and alternative service methods are sometimes allowed. The focus is generally on trying to give the parent actual notice of the case pending and if not that, at least constructive notice that an action has been filed.
can she stop them from moving out?

No. They are adults at that time.
I’m 17 and my boyfriend is 24 and we had a baby together but we left his name off Because we was worried he’d get into trouble and get locked up and I don’t want that because I love him and I might be pregnant again with him and I want to be with him but I don’t know if they will throw him... A 17 year old is still a child, so yes, you can date if your parents allow it. 16 is the age of consent in North Carolina so unless you were having sex prior to being 16, he won't get into any criminal trouble or be 'thrown into jail (at least likely not for getting you pregnant) - so he... Your son signs the citationon that back. Be sure you read the instructions very carefully too as it involves payment of a processing fee and you will not get the hearing if it isnt paid. Then you will be notified f a clerks hearing where you can oppose the issuance of the criminal complaint. Your... View More
My friend is 14 and pregnant shes cant tell her parents because theyll kick her out like they did to her older sister a few years ago and i dont know how to help
answered on Jul 16, 2020
Parents are obligated to support their children and are not allowed to unilaterally 'kick them out' without risking being charged criminally. All the 14 year old would need to do is call local law enforcement or DSS if the parents attempt to kick her out and that will put a stop to that.... View More
She lives in NC and me in Idaho
answered on Jul 16, 2020
You need to go to NC, establish residency and file a Petition for Modification with the court and ask the court to give you the right to take your daughter to Idaho. You have NO right to file anything in Idaho at this point.

Your case has an entire history that led to DFCS involvement and a safety plan. You need to speak to an attorney that can review all of the documents, evidence and hear your story before giving advice about a case in progress.

In theory you can be sued. Anyone can sue anyone. If you are, send it to your insurance company. If you have no insurance, you will likely not be sued.
Even though she was the one who sent the photos to him at the time and he was on the wrong for sending them out but they are both minors so what would be the penalty for them and for some reason he hasn’t gotten a call or anything from the policeman that was supposed to call him and it’s been 5... He needs to get a lawyer immediately because what you described is child pornography which would require him to register as a sex offender.

Likely not much. Since your rights have been terminated, you are no longer an interested party in the adoption proceeding. Am attorney would need a lot more information to evaluate whether anything can be done at this point. I can assure you that without extremely competent local counsel, you will... View More

Can I get this over with? Or do charges get dropped when moved to different state?
answered on Jul 8, 2020
You need to complete the charge problem until it is dismissed or diverted. A conviction will hurt you forever. Talk to your lawyer or hire one that is competent. You will probably be drug tested.

The investigator has threatened to take the case to the District Attorney if you do not bring your son in. It is quite likely that if you do bring your son in for an interview, the investigator will still take the case to the DA, only your son will have made the DA's case a lot easier. The... View More

The receiver saved the pictures without consent and then sent them to other people without my consent. Is the sender more at fault or the receiver?
answered on Jul 5, 2020
No one needs your permission to save the photos you send to them, what would make you think that they do? No one needs your permission to remember what you say to them, or to repeat it to someone else. What you put out on the internet or over texting on the phone is the same thing, and IT LASTS...
