Maybe. Criminals try to get creative at times. If law enforcement knew the tow truck driver was in on the drugs being moved, they could be charged.

A failure to appear under Neb. Rev. Stat. 29-426 can be punished with up to a fine of $500 and up to 3 months in jail. There is no mandatory minimum and this type of charge may be dropped as part of an overall plea deal.
