My daughter said she will kill herself if I stop her from talking to this 13 year old girl I don't know what to do . Can I file a restraining order ?
answered on May 13, 2021
she needs a psychiatrist and medical treatment more than a lawyer.
a mother and father should sit down with her and try to get through to her.

more info will be needed
obviously, you need to get a lawyer either private or by requesting the court appoint the public defender at the arraignment.
write out all the facts and have any wits do the same so the lawyer can evaluate the case and determine if it was self defense or... View More
My 6yr old daughter has missed 18days and thier telling us we have to bring her with us to court shes scared and dont want to go what do we do?

Who told you to bring the child to Court? If it is not an Order from a Judge, then you do not have to. But it sounds like other interested parties want the Child there. Hire an attorney to represent you, and take the Child to Court. Apparently your continued custody is in peril.
Ex. My oldest has several mental health issues and ODD. Once she moved out, it would be likely she would 'get back at us (parents)' by convincing her little sister to run away and come stay with her when things at our house were unfair or she were being punished. Could I press charges on... View More

The offense named Harboring a Runaway Child does NOT apply to siblings or grandparents. See: Texas Penal Code section 25.06(b). Also, the police solve their problems with ammunition. Don't use law enforcement to solve parenting problems.

I'm sorry. Your question does not make sense. It is incomplete.
My sister sent my nephew down here to live with me because he was trying drugs, not doing well in school and coming/going from the house whenever he wanted. At first he was doing so well down here...said it was toxic in NYC and he appreciated the calmer environment. However, now he misses his... View More

Are his parents coming to Florida to find him and/or pick him up? They should consider take responsibility for him and should report him as a runaway. Do you know where he is? You may want to consider speaking with an attorney and moving forward in terms of reporting him as a runaway and/or to... View More

He is verbally and emotionally abusive towards her, has exhibited controlling behaviors towards her. She believes they can do this based on what they told her a police friend told them they... If you wish to discuss this matter off line please feel free to contact me. This type of adult on child abuse makes me very angry and I would rather not air my feelings on this subject here as some may find it offensive. To start with the ages, depending on the birth dates involved, do not... View More
Last night he sent a message to a 15 yr old asking her to have sex with him. I would love to see this person in jail. This is disgusting what he is doing & has done. In Oklahoma, the age of consent for minors is 16. That means it is illegal (because it can't be consented to due to age) for an 18-year-old to have sex with someone 15 or younger. That is called "statutory rape."
I'm sorry that you are in this position.
The fifteen year old and her siblings are extremely close they are placed in 3 homes 3 different counties . She wants to see her siblings and she is told because her parents haven't contacted cps she can not. She has about 8 months till she turns 16 and would like to make steps toward... View More

That's a tough situation. The siblings will be assigned an attorney - a lawyer guardian ad litem - who can help work through that issue.
Specifically, mental abuse. A lot of insults, and not allowing the child to have friends or a love life (child is 16). Punishments for unusual things like accidentally making a mess with food.

You could expose yourself to being arrested for interference with custody if you take in a minor with permission of the parents. If the child needs help, you can contact authorities in your area who can investigate.

Yes, you could up in Florida Parishes Juvenile Detension.
The girl had been arguing with her father and did not want to go home. They arrived at my son's and I's house and were greeted by police. He was charged with harboring a minor. He had just turned 18 three months earlier. They knew each other from high school. The police messed up his name... View More

sorry your son is going through this. However, to assess the case and whether the plea offer is reasonable, it would be best to retain an attorney to look at the police reports and all the facts and do further investigation if necessary in order to better negotiate with the DA.
He was charged as a juvenile. He failed a drug test and was placed in a boys home. The djj is failing him for probation violation and asking the judge to order him to stay in the home until he is 18 1/2. I was wondering if that's possible even though he plead and charged as a juvenile I... View More

Yes, it is possible. See my last answer. His record is not automatically expunged when he turns 18.
My step brother is physically abusive towards me also. It has been reported to dhs twice and to cps in Texas a bunch. No one is doing anything about it.
answered on Apr 24, 2021
When you are 18 you can live where you want. If there is abuse it should be reported. If DHS finds evidence of abuse they will have no problem taking swift action.

In certain circumstances when committed, the court can retain jurisdiction until they are 19.
How can she do it quickly

I'm sorry, but I do not hold out much hope that she will be successful. In 31 years of practice, I have personally known of only 2 emancipations being granted. You can likely look up public access records from the court he was convicted in. It's highly likely that a no-contact order with you remains in place through his term of probation or parole. It is also highly unlikely, given your age and nature of the offense, that a judge will grant your... View More
