Q: My niece was kicked out 3 weeks ago and the mother has had barely any contact with her, has not seen her , nothing.

She is 17 and her mom refuses any type of temporary guardianship til she is 18 in Sept. But doesn't tell her when and if she can ever come home I don't know what to do. i just want the best for her and honestly I believe it is with me. What if anything can I do?

Contact your local children's services which can give you temporary custody.

There is nothing in your story that would suggest either a criminal or juvenile law...This sounds like a daddy-daughter issue and/or a mommy-daddy issue.

You are correct the age of consent in Ohio is 16 years of age. There is a close in age exception for minors. In Texas you are emancipated at 18. Your parents can no longer force you to stay such that a judge or the police would require compliance with your parents decisions, but they can cancel your health and/or dental insurance, not advise you on life in general. Your Court Supervision should be fine, but you really need to have your parents hire a criminal defense attorney for you in order to assist you with these new charges. The sooner an attorney is hired, the better.

She can't move until she is 18 or you can be criminally charged. Call 911 if she is in danger.

I am sorry to hear about your situation. If abuse has occurred, you might consider speaking to your school counselor about the matter. That counselor could make a report to social services.

yes, and as a minor he will need to have a guardian ad litem appointed as he cannot contract for himself. usually that would be you as his parent.

Even if they refuse you can go to a local SS Office or order a birth certificate online or visit your local City Hall in the town you were born in.

Q: can my son be petitioned to juvenile court for not signing something saying he’s guilty of something he’s not?

my 12 yr old was asked to sign a station adjustment for an alleged battery and I told them no, so they want to petition Him to juvenile court. Does this mean he will be arrested? Do I need to bring him in when he didn’t commit the crime or will they issue a warrant?

Yes. It means he will be charged with an offense and go to juvenile court to answer to it.

He can have an adjudication hearing, which is a bench trial where the State has to prove to the judge that he is delinquent (guilty) beyond a reasonable doubt.

If you were charged with a shoplifting charge then it is possible (but unlikely) you will go to jail. Q: What happens when a child goes to Juvenile court that has never been in this situation before?

Ohio does not have emancipation for your situation. Your uncle should talk to children's services to start the custody process.
