If the father keeps exposing the minor child to someone who has placed the child in danger, you should consider a modification action to address these issues.

There aren't any forms for that procedure, so you would need to consult with a lawyer to get that done. Also you have to have the consent of both parents.

The only way to terminate a biological parents are with an adoption. However, unless there is a court order regarding custody, an unwed father does not have any rights to his children, so if you want to merely keep the child away from him, you do not have to do anything; so long as he does not... Check to see whether the citation says if it's "civil" or not. If civil, it will be under 10 grams. If not, then you will receive notification from the Dept. of Juvenile Services to appear for an intake meeting with your parents, and at that time you would likely be offered the... View More

Q: I let my 15tr old brother drive to work, I was with him. we got pulled over. the cop let me drive home.

the cop said he could take my brother to juvenile court and tow my car but he is just going to send us citations in the mail. can my brother get sent to juvie? will I lose my license? I don’t care about paying fines. i’m worried about my brother

Not feeling this is a "juvenile court" matter, but much more a driving-without-a-license matter (which is just a fine). Pay it, and move on. Your brother should be OK. The cop was just trying to scare the both of you -- and looks like it worked.

Best of luck to you.

The felony crime of Sexual Performance By A Child applies anyone under 18 years old engaged in sexual conduct. The plain language of the law criminalizes the conduct itself, even if it does not occur as a performance. If there actually is a performance (or recording) then the parents themselves... View More

It is a difficult to understand the fine line between legitimate corporal punishment (that is, physically disciplining a child using a hand or foot, switch, belt, or 6 x 3 paddle) and child abuse. Hire a criminal defense attorney. There is no recourse against a false accusation except defending yourself unless your son is the victim of intentional misconduct. It would be a very difficult case to claim that a 5 year old was intentionally lying and that a psychologist was intentionally lying.
