This has caused a lot of hardship for me. The day missed was supplied with court papers of defendent and my reference of Tubman following case.
I had been full-time with company 8 years, personal injury? Civil rights?
I was employed full-time for 8yrs. During the last year I had gone through hardships including 2 domestics which made my availability to work difficult at the time. The day they let me go I had court paperwork and Tubman as a reference for my absence. I have been struggling financially due to this.
My boyfriend and I work for the same company, he’s a manager and I’m on the other end of the food chain. I put in my two weeks notice, plan on working it out fully, but after so many years of bull happening there, I thought the higher ups should know what’s happening. Not that I think... View More
Since having my first child in January 2023, there were a few instances of discrimination such as being turned down for an additional role that I was more than qualified for and the reason being communicated that I was a new mom. You can ask, but they may not give it to you. However, if you have suffered discrimination based on pregnancy, you must file a charge with the EEOC within 180 days of the discriminatory action. If you do not, you will lose your legal rights. Also, if you sign a severance agreement it will contain a... View More
I work for a Humanitarin a non profit, who deducts PTO when using California Sick. Is this allowed? My understanding of this law is that PTO and Sick are supposed to have separate “banks” and sick hours are completely separate and guaranteed hours.

If you have sick leave accumulated, the employer should only be deducting from your sick leave if you are out sick. If you have no sick leave accumulated or run out, then you can draw on your accumulated PTO. Your employer can not require you to use PTO for sick, when you have accumulated sick... View More
I'm a CNA and work at a retirement home.
I was hired to work two days a week at my company at a location 30miles away, I was told I needed to provide my own transportation and pay for gas. I’ve never worked a place that required that. Iam in California.
answered on Jan 5, 2025
You might be worried about the extra cost of commuting to a work location 30 miles away. In California, the law usually doesn't force an employer to reimburse you for a normal commute, even if it's lengthy.
You may want to check if any company policies or union agreements... View More
Doing insurance repairs on vehicles, if a part is damaged upon removal and insurance refuses to pay can my employer make me eat the cost?
Initially signed for 84hrs a week. Then a few months later the employer came back and had us sign a new contract for 70hrs. When we travel they adjust our hours as well. Currently only allowing me to work 60hrs, with no overtime. I had to work a few hours with another site and informed the higher... View More
I saw an article how Texas overruled the law, is that only on Texas or all over the U.S.? My husband is a Salary employee making less than $58k a year. He works over 40 hours a lot and last year they only paid him 1/2 time (so $11 an hour) whenever he went over 40 hours.
It ended abruptly. Ever since, he's been treating me poorly, jerking me around, and I think he's trying to get me to quit. I would like to push back because my quality of life is suffering and I'm not going to be forced out of the company.
Unfortunately I do not have all the... View More

If they comply with the Covenants Not to Compete Act, yes.
This is a fairly specialized area of practice which our firm handles often. I personally have represented both sides--those trying to enforce a non-compete, and those trying to prevent enforcement. Even if you were to read the... View More
