You need not be in Florida to file for the divorce here. You did not indicate where the children are currently located and that could become and issue if they are outside the state. The State could use the person's testimony alone to try and convict you. If the judge believes this person, it is enough to sustain a conviction. However, the standard is beyond a reasonable doubt and it may be difficult for the State to prove guilt beyond a reasonable doubt without corroboration.
