If you are bringing a claim against New York State (or an agency of NYS), said action must be brought within the Court of Claims. And before you can bring any such lawsuit, you must first file a Notice of Claim (or Notice of Intention to file claim) within 90 days of the incident.

Hopefully her name is only on the mortgage and not on the deed. If her name is still on the deed you should act to correct that situation immediately.
